Idaho’s Investor Protection Laws.
Idaho has strong laws (known as securities laws) to protect investors from investment fraud and abuse. In Idaho, a person who sells you investments by “misrepresentations or omissions of fact,” or through a “device, scheme or artifice to defraud” is required to return your investment money, plus interest set by law every year. Idaho’s securities laws also give investors rights against people who worked behind the scenes in selling an investment to you, including lawyers, accountants, and others who made the sale possible. The Idaho Uniform Securities Act is found in the Idaho Code, and the most important provisions for victims of securities fraud in Idaho are in Section 30-14-509. The Idaho Legislature has made all of Idaho's statutes available online at www3.idaho.gov.
FINRA Arbitration.
The Financial Industry Regulatory Authority (FINRA) has an arbitration procedure for people who seek to recover their investment losses. The law requires that most investment recovery cases against stockbrokers and advisors be filed in a FINRA arbitration. FINRA's Idaho cases are heard in in Boise. We are experts in FINRA arbitration. Not only do we represent investors in FINRA arbitrations, but Mr. Banks has been a FINRA arbitrator himself since 1991.
State and Federal Courts:
Each of Idaho's counties has a courthouse where investors can bring claims to recover their losses. In addition, there are federal courthouses in Boise, and Couer D’ Alene where investors can bring claims to recover their investment losses. Through lawyers we associate with in Idaho, the Banks Law Office has represented clients in Idaho county court, the Idaho Supreme Court and federal courts in Idaho to assist our clients.
